General Conditions

These General Conditions regulate the relations between STAR ALLIANCE Ltd, as a supplier, and its customers, as users of the supplier's website www.tendenz.ro. Tendenz is a trademark and everywhere in the general conditions under the name Tendenz the owner of the trademark STAR ALLIANCE Ltd is considered.

І. General provisions

1.2. The user declares that he is familiar with these general conditions and by clicking on any link, button, image or application located on the website www.tendenz.ro, the user expressly and unconditionally agrees to them.

1.3. Tendenz reserves the right to modify the design of the website www.tendenz.ro, its content and these general conditions at any time. The modifications enter into force from the date of their implementation / publication on www.tendenz.ro

ІІ. Terms The terms used in these general conditions have the following meanings: The Internet page is a collection of websites included in a common website, which are loaded in your browser by entering the address www.tendenz.ro. A user of www.tendenz.ro is any person who entered the web address or reached www.tendenz.ro by referral from another site to make purchases of goods electronically.

Registered User - is any person who has performed the actions indicated by Tendenz, as a result of which they are included in the Tendenz database and have the possibility of checking their order history at www.tendenz.ro

Quick Order User - is any person who has performed the actions indicated by Tendenz to order goods from www.tendenz.ro, without being registered and included in the Tendenz database.

Browser - a computer program that provides the possibility of transferring, processing and viewing data through various types of data transfer protocols. Malicious actions are actions or inactions that violate Internet ethics or cause harm to persons connected to the Internet or associated networks, sending spam (unsolicited commercial messages, spam), accessing resources with other persons' rights and passwords, using system deficiencies for the purpose of obtaining personal benefits or acquiring data (HACK), performing actions that can be qualified as industrial espionage or sabotage, damaging or destroying information systems or mass media (CRACK), sending "Trojan horses" or causing the installation of viruses or remote control systems, disrupting the normal activity of other users of the Internet and related networks, performing any activities that can be classified as crimes or administrative offenses under Bulgarian law or other applicable laws.

User profile - is a separate part of www.tendenz.ro, which contains information about the user - the e-mail address and password, through which the services provided by Tendenz are accessible and through which the exchange of information between the user and Tendenz takes place; Distance sales contract - any contract concluded on the basis of a proposal from Tendenz and a user, as part of a system for the sale of goods or the provision of services, in which from the date of sending the offer until the date of conclusion of the contract the parties do not have physical contact. Each order placed represents a separate contract. By making an electronic declaration of conclusion of a sales contract, the user agrees to the General Conditions and the content of the distance sales contract, which provides for payment methods, accessible at a location www.tendenz.ro. Brochures / notifications / messages - means of information, especially electronic, relating to the products and services offered by Tendenz and those of its partners, including the purchase of vouchers or promotions offered during a certain period of time;

III. Confidentiality of the data provided

3.1. Personal data received by Tendenz upon registration or upon conclusion of the sales contract without registration will be used only for servicing users – accepting and fulfilling orders and for contacting users in case of any problems related to the order.

3.2. Tendenz meets the requirements of the personal data protection law and is responsible for ensuring the protection of user data known upon conclusion of the distance contract, except in cases of force majeure, accidents or malicious acts of third parties.

3.3. By accepting the general conditions, the user agrees that his data will be stored and processed in accordance with the law and agrees that his personal data, declared accessible to the general public in his user profile at www.tendenz.ro, will be used by Tendenz for direct marketing purposes.

3.4. Tendenz undertakes not to disclose personal information about the user and not to provide the collected information to third parties - government bodies, commercial companies, individuals and others, except in the following cases: - it has obtained the express consent of the user upon registration or at a later date; - the information is requested by state bodies or officials, who according to the legislation in force have the right to request and collect such information in accordance with statutory procedures; - other cases provided for by law.

3.5. By registering on www.tendenz.ro, the user agrees to receive personal messages, advertisements or other commercial messages from Tendenz at the specified e-mail address.

IV. Use of the website www.tendenz.ro

4.1. When using the Tendenz website, the user is responsible for all consequences resulting from his/her behavior, including any material, intellectual, electronic or other damages caused to the website, services, Tendenz or any other person with whom Tendenz has signed a collaboration or service provision agreement in accordance with Bulgarian law.

4.2. The website is addressed to users with and without registration. The possibility of placing online orders is available to users residing in Romania or outside the territory of the country. Persons under the age of 18 do not have the right to make statements and conclude contracts, according to these general conditions. By sending an order and / or creating an account, the user declares that he/she is an adult (person over 18 years of age).

4.3. By accepting these general conditions, the user is informed that all content, including images, text and / or multimedia content, design, software, databases, information and any other content, published on www.tendenz.ro is the property of Tendenz.

4.4. The user does not have the right to copy, transfer, modify, use, provide, etc. the content of www.tendenz.ro, without the express written consent of Tendenz, except in cases of non-commercial use.

V. Order, contract and payment of the price

5.1. The user has the right to order all products present in www.tendenz.ro. When placing the order, the user has the right to select the type, brand and model of the goods and their quantity, the payment terms, the method and conditions of delivery, depending on the possibilities offered by www.tendenz.ro. When placing the order, the user enters into contractual relations with Tendenz for the sale-purchase of the selected item, regulated by these general conditions. The distance sales contract between the user and Tendenz is considered concluded from the moment of confirmation of the specific order by Tendenz.

5.2. The online shopping system through the website reflects the availability of items at the current time, given the sales dynamics, it is possible that certain products published and listed on the website as "available" at the time of sending the order are out of stock and cannot be ordered / confirmed and delivered by Tendenz.

5.3. All orders received on Friday evening, Saturday and Sunday or during official holidays are processed on the next business day.

5.4. Payment of the contract price is made through the methods indicated on www.tendenz.ro, by making the payment the user makes a voluntary declaration that he agrees to pay for the product and agrees to the general conditions. 5.5. The prices of the products mentioned on www.tendenz.ro.ro are final prices and include VAT. The delivery cost is paid by the user upon fulfilling the order.

5.6. Tendenz reserves the right to change product prices, as well as those for delivery.

VІ. Delivery

6.1. The ordered products are delivered by the courier company DPD and Sameday to the address specified by you.

Delivery is made within seven working days. Delivery fee by DPD courier to the address and to the locker – 18 RON. Delivery to the address via Sameday – 15 RON, and to easybox Sameday – 14 RON. Delivery is free for orders with a total value over 250 RON on the territory of Romania!

6.2. Upon delivery, the recipient signs the consignment note, which certifies the proper fulfillment of the order.

6.3. Tendenz offers the possibility of placing international orders, to which these general conditions apply. International deliveries are made through a courier company.

VІІ. Complaints. Warranty. Order refusal.

7.1. Complaints for visible defects are claimed within 3 days of purchasing the goods, and for hidden defects upon their discovery, but no later than the expiration of their warranty period. The costs of returning the product, related to the complaint and sending a new product are borne by the seller. 7.2. The commercial warranty period for shoes and bags is 30 days, and for suitcases up to 6 months, applies to products purchased in the European Union. In case of peeling and/or defects that can be removed and only if they are not caused by improper use, the shoes are repaired within 30 days and sent by courier to the customer. For suitcases, the warranty does not cover damage caused by improper use, high temperatures, humidity, natural wear and tear of materials or intentional damage. The warranty does not cover damage caused by the negligent attitude of airport employees and other logistics companies involved in the transportation and handling of goods and luggage.

7.3. If the consumer has ordered a product that does not fit his size, he has the right to return the product at his own expense.
7.4. Refusal of the order Pursuant to art. 50 of the Consumer Protection Act, the consumer has the right to withdraw from the distance contract without giving a reason and without incurring any costs, without owing compensation or incurring penalties or costs, with the exception of the costs provided for in art. 54, paragraph 3 and art. 55 of the Consumer Protection Act, within 14 days from the date of: acceptance of the goods by the consumer or by a third party other than the courier. The right of refusal may be exercised only if the following conditions are met: the purchased goods must be in the original packaging, without traces of use or violation of its commercial appearance and accompanied by all documents received with the product, in accordance with the provisions of art. 55 of the Consumer Protection Act. The transport costs incurred in returning the goods by the user of the Tendenz company are borne by the consumer, the return being made to the office of Vladaiska Reka Street 2, Sofia 1510, Bulgaria. Tendenz shall refund the amount paid by the user to the user's bank account no later than 30 days from the date on which the consumer exercised his right of withdrawal from the concluded contract. If the consumer exercises his right of refusal from the distance contract, the user must send or deliver the goods back to the trader or a person authorized by him, without undue delay and no later than 15 days from the date on which the consumer communicated his decision to withdraw from the contract to the trader. The final deadline is considered met if the user sends or delivers the goods to the trader before the expiry of the 14-day period. When the user returns the goods purchased from www.tendenz.ro via the DPD courier company, the amount related to the respective goods is refunded after opening the package and finding, by drawing up a report of findings, that the product meets the requirements listed above in p.7.5. 4. If the product does not correspond to the above, it is returned to the consumer at the address from which it was sent to the Tendenz company. VІІІ. Disputes and complaints

8.1. In the event of situations related to unresolved issues, the customer has the right to present the controversial issues to one of our assistants at the correspondence address.
8.2. Any disputes that may arise between Tendenz and the user will be resolved by mutual agreement. If this is not possible, they will be addressed to the competent court, in accordance with Romanian law.
